規約/Terms (ver.1:2018/11/1)

第1条(サービス/Service)
本サービスは、店の経営者(利用者)が、割引などのクーポンを発行・提供し、利用者がそのクーポンの入手・使用をすることを原則とし、その他の利用を認めない。また、発行の責務を負える店の経営者相当の利用者のみが、クーポンを発行し、また、発行したクーポンの責務を負うものとする。 This said service means that the store manager (user) issues and provides coupons Such as discounts, and anther user obtains and uses the coupon. 第2条(本規約への同意) Agree to these Terms)
1)利用者は、本利用規約に同意頂いた上で、本サービスを利用できるものとします。 You can use this service under you agree to these terms of service.
2)利用者が、本サービスをスマートフォンその他の情報端末にダウンロードし、本規約への同意手続を行った時点で、 利用者と当方との間で、本規約の諸規定に従った利用契約が成立するものとします。 By downloading this service to an information terminal such as a smartphone and performing the consent procedure of this agreement by the user, a user contract and an available contract according to the terms of this agreement are established between us and the customer.

第3条(規約の変更/ Change of contract)
1)当方は、利用者の承諾を得ることなく、いつでも、本規約の内容を改定することができるものとし、利用者はこれを異議なく承諾するものとします。 We can revise the contents of this Agreement at any time without obtaining the consent of you, and you will accept it unannounced.

第4条(アカウントの管理/Account Management)
1)利用者は、利用に際して登録した情報について、自己の責任の下、管理をゆだねるものとします。 利用者は、これを第三者に利用させ、または貸与、譲渡、名義変更、売買などをしてはならないものとします。 The user shall leave management under the responsibility of the user concerning the information registered for use. 第5条(禁止行為/ Prohibited action)
本サービスの利用に際し、当方は、利用者に対し、次に掲げる行為を禁止します。当方において、 利用者が禁止事項に違反したと認め た担ム 利田の停止、退会処分その他当方が必要と判断した措置を取ることができます。 When using this service, we will prohibit the following acts to the user. (6) クーポンの譲渡及び現金化する行為。Transfer of coupons and acts of cashing.

規約に違反した者及び虚偽の申請した者は、全責任を追う者とし、当方または、他のユーザへの損害を補償するものとする。

第6条(免責/ Disclaimer)
1)当方は、本サービスの内容変更、中断、終了によって生じたいかなる損害についても、一切責任を負いません。 We do not assume any responsibility for any damage caused by content change, suspension or termination of this service.
2) 当方は、利用者の本サービスの利用環境について一切関与せず、また一切の責任を負いません。 We are not involved at all about the users environment of the service and do not take any responsibility.
3) 当方は、過失による行為によって利用者に生じた損害のうち、特別な事情から生じた損害については、一切賠償する責任を負わないものとします。 We are no responsibility for damages arising from special circumstances out of the damage caused to the user by the act of negligence at all.
4) 本サービスの利用に関し当方が損害賠償責任を負う場合、当該損害が発生した月に利用者から受領した利用額を限度として賠償責 任を負うものとします。 In case we are liable for damages relating to the use of this service, we shall assume liability for compensation up to the amount of money received from the user in the month in which the damage occurred.

第7条(譲渡・換金行為の禁止等/Prohibition of transfer and cashing)
本サービス内で取得した一切のコンテンツについては、売買その他、金銭その他現実世界における対価を授受する形でのあらゆる譲 渡、譲受、貸与、 借用等する行為を禁止いたします。With respect to all contents acquired in this service, we prohibit any transfer, transfer, lending, borrowing etc. in the form of selling and buying, other money, or exchange of consideration in the real world.
第8条(サービスの終了/End of service)

第9条(当方の役割・立場/Our position)
1)本サービスは、利用者間における商品・サービスの売買その他の取引のための場・機会を提供することを内容とするものです。 そのため、当方は、個別取引の当事者にはならず、売買契約の取り消し、解約、解除、返品・返金や保証などの個別取引に関しては一切関与いたしません。 This service is based on providing a place and opportunity for trading and other transactions of goods and services among users. CuoChaの抽選ルール/CuoCha Drawing Rules(ver.1)

獲得できるクーポン/Coupons you can earn：
●当アプリで登録された店のオーナが、責任を持って発行し、提供される。
/The coupns are issued and offerer by the owner of the shop registered with this application.
（当アプリが代行して配布するものである。/This application will be distributed on behalf of the owner of the shop.）
●最大でも2週間の期間限定のクーポンとする。/Time limited coupon for a maximum of 2 weeks.
●クーポンの推定価値金額の上限は 50,000 円以内とする。/The maximum estimated value of coupon shall not exceed 50,000 yen(about 500 US dollars).
●クーポンは実際の現品または、実際のサービスの割引内容とする。/The coupon shall be the discount of the actual item or actual service.

抽選設定/Drawing Setting：
●ユーザは、現在位置または、指定位置を指定し、その周辺の店が発行したクーポンを無作為に獲得するものとする。 / The user designates the current position or designated position and randomly acquires the coupons issued by the shops in the vicinity.
●ユーザが重複して同一のクーポンを入手できない。/ Users can not obtain the same coupon redundantly.

抽選ユーザ/ Lottery Users：

●抽選利用者は、当サービスの規約、ルールに合意した者とする。 /Lottery users mustl agree on the terms and rules of this service.
●抽選実施により、当サービスの規約、ルールに合意したこととする。 /By doing drawing a coupon, terms and rules of our service are accepted.

クーポン発行者/Coupon issuer：
●店舗登録した者、及びクーポン発行者は、クーポンの全ての責任を負うものとする。 /The person who registered the store and isse the coupon must bear all responsibility for the coupon.
●店舗登録、及びクーポン発行によって、規約、 ルールに合意したことする。 /By registering stores and issuing coupons, the terms and rules are accpeted.
●店舗情報は、集客のためのみに使用し、くじ引きで当たった一般の不特定ユーザに提供されます。 /Store information is used only for attracting customers and is provided to ordinary unspecified users hit by coupon drawing.
●下記の違反行為の場合は、他のサービスを含め、一切の本サービスの使用ができなくなります。 /In case of the following violation, you can not use any service including any other services.

1)偽りの店舗情報、架空の店舗情報/Fake store information, imaginary store information.
2)偽りクーポン、架空のクーポンの発行/Fake coupons, issuance of imaginary coupons.
39現金、金銭の取引内容/Transaction of cash, money.
4)暴力的、性的表現/Violent, sexual expression.
5)銃、麻薬、武器などの違法製品の取引/Trading illegal products such as guns, drugs, weapons.
6)違法なサービス/Illegal service.
7)インターネット取引/Internet transaction and purchase.
8)ポルノ関連の取り扱い/ Treatment of pornography.
9)不正websiteへの誘導/Induction to a wrong, malignant website.
10)過剰な割り引き内容/Excessive discount details.
11)割り引きと無関係のクーポン/Coupon unrelated to discount.
12)犯罪、違法を促す行為/ Crime, acts to encourage illegality.
13)思想・宗教の拡散/Diffusion of religion or thought.
14)わいせつ表現、残虐な表現、著しく暴力的な表現、名誉毀損行為/Obscene expression, cruel expression, expressive violence, defamation.
15)タバコなど中毒性製品の販売/Sales of toxic products such as tobacco.

抽選の運営/Operation：
●当サービスは、Apple社とは、一切関係ない/This service is not related at all to Apple, Inc.
（Apple社は、当アプリのスポンサーではない。/Apple, Inc. is not a sponsor of this application.）
●提供確立、割合の改ざん等、不正が起きない様に、システムを適切に管理する。 /We properly manage the system so that violation does not occur, such as establishment of provision, tampering, etc.
●当サービスによって、生じた損害・不利益は一切、当方の責任ではない。 /Any damage or disadvantage caused by this service is not our responsibility at all.

ルールの変更/Rule change：
●当抽選のルールは変更する場合があり、大きな変更の場合は通知することとする。
/The rules of this drawing may be changed, and will be notified in case of major changes.
